Home Sweet Home: Legal Process & Housing Loan

MH and I continued the house hunting for the next following months. It took us quite a long time to find our dream (dream lah sangat!) house to call our own, mainly because we were looking for these specific set of criteria - a landed house, corner lot, somewhere near Putrajaya but still not quite far from KL. There were a few houses that we really like, but the price was sooo high, like very close or even more than a million! Mahal tak hengat!!! Sometimes I wonder how much do these people have to pay for the mortgage and how on earth they can afford it? Kerja apa? Business apa? (Statement jealous sebab terpaksa mengucapkan bye-bye kepada rumah-rumah cantik tapi mahal tu!) One more thing that made me also frustrated was the fact that most of the corner houses had been converted to kindergartens. What to do, takde rezeki.

To cut the long story short, we finally found our perfect house. It was a single storey semi-D, very near to Putrajaya. Not really our dream house based on its current condition (rumah lama) but it was as close as we could get. And the price pun kira mampu milik. (Akhirnya pasrah dan ukur baju di badan sendiri!).

The next process - negotiation with the owner, 10% deposit, S&P bla-bla was so smooth and fast. Alhamdulillah. Little did we know that the challenge this time came in a different form dealing with the so-called professional people in the related field.

#1 - The Siput Loan Officer. When we met the lawyer at his office, for the signing of the S&P, he introduced us to this lady officer from this bank for our housing loan application. Senang sikitlah kononnya, as we got to settle two things at one go. But it turned out that this lady was so slow and incompetent. After we submitted the application and everything, dia senyap je. When I did the follow-up, macam-macam cerita pulakDokumen tak lengkap, dia cuti bla-bla. Bila dah submit semua, senyap lagi. Kena follow-up lagi. Minah ni buat kerja macam takde check-list. When we called her again, she would asked to give the latest payslips and bank statements sebab dah lebih sebulan. Memanglah, sebab ko lembap sangat!! Than nothing. This procrastination had going on for a few months. Memang tak logik! Finally, after 4-months or so, plus marah-marah kat dia, finally she informed me - we didn't get the loan. Ha???? How could it be? The price of this house was much more lower than the one that we got earlier. Logically thinking, kalau kami pernah dapat kelulusan loan untuk rumah yang lebih mahal dari yang ini, patutnya boleh dapatlah kan loan untuk rumah ni? She failed to give us the answer. 

Time is running out and the owner started asking for the full payment. Deal or no deal. Kelam kabut hantar loan applications to various banks. Nasiblah mana yang sangkut. Alhamdulillah, within a week or two, we got feedbacks already from the banks. It turned out that our names were still in the system for the first loan that we got for the previous house. But the money was not released and the  previous lawyer had already notify the bank about the termination of the purchase. Upon hearing this, we quickly made an official letter to the bank to notify them to take out our names from the system. The following day, MH went to the bank to submit the letter and the relevant documents. In no time, our records were clean again. It was that simple. Cik Pegawai Malas sila baca!!

As the result, within a few weeks, we got not only one, but three loan approvals!Alhamdulillah =)

#2 - The Siput Loan Lawyer Naik Kereta Lembu (bayangkan betapa lembapnya!) . Unfortunately, the drama did not end there. Kali ni cubaannya dalam bentuk loan lawyer. Lawyer yang ni panel kepada bank. Bukan lawyer S&P kami yang cekap dan best. After almost a month after the bank submitted the related documents to her office, barulah her staff called me to ask for additional documents. Immediately I submitted the document. Then senyap. After a month called again asking for contact number of the S&P lawyer. Then senyap lagi. That was it. I made the initiative to call the S&P lawyer to ask about the necessary steps that the loan lawyer need to take as I was not familiar with the process. After getting some tips from him, I bugged the loan lawyer (the staff actually, the lawyer never called, I never spoke to her. And her staff that did the follow-up asyik tukar-tukar aje!). Asyik bagi alasan, I gave the ultimatum. "I want to go to the Land Office at this date, you better be there with the documents". Tiba hari kejadian, drama lagi!! Staff yang datang tu pulak cover kerja orang lain. It turned out the documents were not complete, she did not even made enough copies to be submitted. Even the clerk at the Land Office hairan how could this law firm be so careless! Masa tu memang hangin giler, buang masa semua orang! MH called the lawyer directly, kaw-kaw ler dia kena. Tak profesional langsung! Akhirnya terpaksalah I used my budi bicara to meet the ADO personally and explained the situation. Luckily he was my junior in ther service and very helpful too. Kalau tak memang sia-sia buang masa separuh hari di Land Office.

After that I called the lawyer's office every alternate days to ask exactly progress dah sampai mana. Memang tak boleh percaya kalau tak buat nacam tu. Tapi masih lambat, up to a point they did not answer my call at all. Dah agak, mesti diaorang cuba nak mengelak. Terkantoi juga satu hari tu. Penat bercakap dengan staff yang entah apa-apa, MH requested to speak to the lawyer personally. The answer was that she was not in the office. Asked for her handphone number, tak bagi pulak. Boleh macam tu layan client? So, I tried to call immediately after that but this time around using a different name. Walla! Macam magic, in less than 3 minutes, she WAS in the office!! Apa lagi, kenalah lagi kemarahan buat sekian kalinya!!! I even made a complaint to the bank. They need to know how their panel lawyer was behaving towards their clients! Tau pulak takut si lawyer ni. Terus bagi nombor handphone dia and bagitau dia akan handle my file personally. Memang patut pun. Ni bukan kerja bona fide! Dah kena threatened macam tu, barulah laju kerja dia. In less than two weeks, the cheque for the owner was ready. Masa bulan puasa hari tu. Finally, alhamdulillah.

Lesson learnt from this experience:

#1 - When applying for the housing loan, submit as many applications as you can to various banks no matter how confident you are to get the loan - like in my case. Don't rely solely on one bank and waste the precious time waiting for the result.

#2 - Make the effort to know and understand the whole process completely and ask the lawyer / officer etc about the estimated time to complete the process and DO make follow-ups. Don't wait for them to contact you, they won't.

#3 - Don't hesitate to exercise your right as the client. Speak up and report to the relevant party if you are not satisfy with the service. In my case, it was not my intention to scold people like that. I am usually have a very high tolerance towards other people. But this two people really tested my patience. Dah bagi kerjasama, even facilitated and coached them, tapi masih lembap juga plus banyak beralasan, memang nak kenalah.
